It’s important to remember that diminished values are subject to certain limits. The federal government set a 10% cap for this type of damage, known as the base loss of value. This means that the maximum you can claim for diminished value is ten percent of the car’s original sales price. A vehicle’s diminished-value cap is based on the extent of the damage to it. The underlying principle behind these limits is that the lessor has the greater burden of proof, while the insurer will be required to prove that the car was worth the lesser amount.
